Tweede voortgangsrapport inzake de strategie voor de vereenvoudiging van de regelgeving

1. INLEIDING

De strategie voor vereenvoudiging van de regelgeving, waarmee in oktober 2005 een begin is gemaakt, gaf de hoofdlijnen aan van een lopend programma van vereenvoudigingsmaatregelen die in de periode 2005-2008 goedgekeurd zouden moeten worden, met het doel de kwaliteit en de effectiviteit van het acquis te verbeteren met handhaving van de voornaamste beleidsdoelen.

Dit tweede voortgangsrapport, dat een aanvulling vormt op de mededeling over de ' Tweede strategische evaluatie over betere regelgeving in de Europese Unie' , beschrijft, zowel in kwalitatieve als in kwantitatieve termen, de reeds behaalde resultaten, geeft de te volgen richting aan voor de EU-wetgever, en zal hopelijk een nieuwe impuls geven aan de vereenvoudigingsstrategie, die een essentieel element vormt van het algemene beleid inzake betere regelgeving en de strategie voor groei en banen van de Europese Unie.

Dit verslag laat ook zien dat de Commissie haar toezeggingen in het kader van het lopende programma nakomt.

Burgers en ondernemingen hebben al concrete resultaten kunnen constateren en zij zullen er nog meer zien naarmate de talrijke initiatieven die momenteel bij de wetgever in behandeling zijn, goedgekeurd worden. De inspanningen zijn vooral gericht op projecten die wezenlijke voordelen voor stakeholders met zich zullen brengen, bijvoorbeeld voor kleine en middelgrote ondernemingen (KMO's) of individuele ondernemers, die nog te vaak met onevenredig zware regelgeving geconfronteerd worden.

De Commissie zal een volledige screening van het acquis van de Gemeenschap voltooien om na te gaan of bestaande instrumenten nog wel nodig zijn, of de juiste regelgevingsaanpak wordt gevolgd, en of de opgelegde lasten niet zwaarder zijn dan strikt nodig is voor de nagestreefde beleidsresultaten. In het kader van dit proces zullen ook nieuwe initiatieven voor opname in het bijgewerkte lopende vereenvoudigingsprogramma, dat begin 2009 voorgesteld zal worden, geïdentificeerd worden. Om een wezenlijk effect te kunnen behalen, dient dit momentum ook in de volgende legislatuurperiode op gang gehouden te worden.

Tegelijkertijd zal de Commissie, in alle gevallen waar het leven gemakkelijker kan worden gemaakt voor het bedrijfsleven zonder de onderliggende beleidsdoelen aan te tasten of ingrijpende veranderingen van het regelgevend kader voor te stellen, gebruik maken van het zogenaamde 'dringende acties'-mechanisme dat de administratieve lasten in de EU tegen 2012 met 25% moet helpen reduceren. Ook het grootschalige initiatief van de Commissie betreffende het 'in kaart brengen en meten' van de administratieve lasten op bepaalde prioritaire terreinen zal een stimulans vormen voor het vereenvoudigingsprogramma.

2. STAND VAN ZAKEN VAN HET LOPENDE VEREENVOUDIGINGSPROGRAMMA

2.1. Overzicht

In de vereenvoudigingsstrategie van oktober 2005 werd een eerste reeks van ongeveer 100 initiatieven voor het lopende programma voor 2005-2008 geïdentificeerd. In november 2006 werden daar 43 nieuwe initiatieven aan toegevoegd, en nog eens 16 in oktober 2007, waardoor de reikwijdte van de vereenvoudigingsstrategie uitgebreid werd tot alle beleidsterreinen, en het tijdschema verlengd werd tot 2009. Het programma maakt gebruik van wetgevingstechnieken als intrekking, codificatie en herschikking.

De uitvoering van het lopende programma verloopt in grote lijnen volgens plan. De Commissie heeft al meer dan de helft van de initiatieven van het bijgewerkte programma voor 2005-2009 goedgekeurd.

Van de initiatieven die in 2007 goedgekeurd hadden moeten worden, heeft de Commissie 80% afgehandeld.

De Commissie heeft tot nu toe 91 voorstellen afgehandeld, waaronder 24 zogenaamde autonome wetsbesluiten die via de comitologieprocedure zijn goedgekeurd, 16 die door de wetgever zijn goedgekeurd, 44 die nog in behandeling zijn bij de wetgever, en 7 herzieningen waarvoor ingrijpen van de wetgever niet vereist is, of gecombineerde initiatieven.

In totaal heeft de Commissie sinds oktober 2005 al voorstellen ingediend betreffende ongeveer 400 wetsbesluiten die ingetrokken, gewijzigd of vervangen zouden moeten worden. Als gevolg daarvan zullen ongeveer 300 wetsbesluiten – in totaal ongeveer 5 000 bladzijden Publicatieblad – uit de communautaire wetgeving geschrapt worden. Verder heeft de Commissie sinds zij in functie is al actie ondernomen of voorstellen gedaan voor het verwijderen van ongeveer 2 500 verouderde wetsbesluiten uit het acquis .

2.2. Reeds goedgekeurde wetgeving

De tenuitvoerlegging van de strategie voor vereenvoudiging van de regelgeving heeft al aanwijsbare voordelen opgeleverd voor het bedrijfsleven en de burgers.

2.2.1. Door de Commissie goedgekeurde besluiten

Tot nu toe zijn 24 vereenvoudigingsinitiatieven via de comitologieprocedure goedgekeurd als autonome wetsbesluiten van de Commissie (bijlage 4). Voorbeelden:

- In 2005 heeft de Commissie een verordening goedgekeurd betreffende lagere vergoedingen en administratieve bijstand voor KMO's die geneesmiddelen laten registreren. Deze verordening voorziet in een reductie met 90% van de vergoedingen voor wetenschappelijk advies voor KMO's, in verlaagde vergoedingen voor KMO's wanneer zij een vergunning voor het op de markt brengen van geneesmiddelen aanvragen, en in procedurele bijstand voor KMO's. De KMO's die op dit terrein actief zijn, maken al uitgebreid gebruik van deze mogelijkheden;

- De regels betreffende bewijs van invoer in derde landen (in verband met gedifferentieerde restituties voor bepaalde landbouwproducten) zijn aangepast om exporteurs die restituties aanvragen toe te staan om daarbij desgewenst gebruik te maken van de traceringsgegevens van de containertransporteurs, in plaats van van de gebruikelijke douanedocumenten (die in bepaalde landen moeilijk te verkrijgen zijn).

- De Commissie heeft al een aanbeveling betreffende elektronische communicatiemarkten goedgekeurd waarin wordt voorgesteld de regelgeving op het groothandelsniveau te richten en het aantal markten waarop ex ante -regelgeving van toepassing is terug te brengen van 18 tot 7. Dit zal naar schatting leiden tot een verlaging van de administratieve kosten met ongeveer 25-30% voor exploitanten van vaste netwerken met ongeveer 30-40% voor nationale regelgevende autoriteiten (NRA's). Vereenvoudigde procedures voor de evaluatie van de markt zullen eveneens leiden tot verdere besparingen voor NRA's.

2.2.2. Door de wetgever goedgekeurde besluiten

Voor het leeuwendeel van het programma is goedkeuring door de communautaire wetgever vereist, in de meeste gevallen via de medebeslissingsprocedure. Tot op heden zijn 16 vereenvoudigingsinitiatieven in het kader van het lopende programma 2005-2009 goedgekeurd (bijlage 5). Enkele voorbeelden:

- Wat de landbouw betreft, heeft de wetgever de herschikking van de 21 organisaties van de gemeenschappelijke markt in één enkele regeling goedgekeurd, met het oog op stroomlijning en vereenvoudiging van het Gemeenschappelijk Landbouwbeleid, ten voordele van landbouwers, overheidsdiensten en ondernemingen die met landbouwproducten van doen hebben. Door de oprichting van één enkele organisatie zal de wetgeving in de landbouwsector afgeslankt worden en zal het beleid doorzichtiger en begrijpelijker worden. Dit houdt in dat bijna 50 wetsbesluiten van de Raad ingetrokken moeten worden en dat meer dan 650 wetsartikelen in de bestaande verordeningen vervangen worden door ongeveer 200 artikelen, waardoor de regelgeving sterk vereenvoudigd zal worden zonder dat het onderliggende beleid wordt aangetast.

- De richtlijn betreffende beroepsmogelijkheden in verband met overheidsopdrachten. In deze sector ging in 2003 een geschat bedrag van 1,5 miljard euro om, ofwel 16,3% van het BBP van de EU-15. De nieuwe richtlijn verbetert de nationale beroepsprocedures waarvan ondernemingen gebruik kunnen maken wanneer zij menen dat een overheidsdienst onjuist heeft gehandeld bij de toekenning van een contract. De richtlijn voert een verplichte status-quoperiode in tussen de kennisgeving van de beslissing betreffende de toekenning en de ondertekening van het contract, om de andere inschrijvers de tijd te geven om de beslissing te bestuderen en te overwegen of een beroepsprocedure eventueel zin heeft. De Richtlijn bevat aanvullende regels om de effectiviteit ervan te waarborgen. De invoering van deze nieuwe rechten en mechanismen ten behoeve van afgewezen inschrijvers in alle 27 lidstaten is van groot belang om ervoor te zorgen dat contracten uiteindelijk toegekend worden aan de onderneming die de economisch meest gunstige offerte heeft gedaan, en daarmee bij te dragen tot meer vertrouwen onder ondernemers en het publiek in de eerlijkheid van openbare aanbestedingsprocedures. De vereenvoudigingsmaatregelen omvatten de intrekking van bestaande mechanismen voor bemiddeling en attestering, waarvoor het bedrijfsleven weinig belangstelling heeft getoond en die momenteel ongebruikt blijven.

- De richtlijn betreffende betalingsdiensten draagt bij tot het creëren van een 'Single Payments Area' (één betalingsgebied) in de EU, die de EU-economie tot 28 miljard euro per jaar zou kunnen besparen. Het doel is elektronische betalingen binnen de EU – per kredietkaart, debietkaart, credit transfer, rechtstreekse afschrijving of op een andere manier – even gemakkelijk, goedkoop en veilig te maken als binnenlandse betalingen binnen een lidstaat nu al zijn. De richtlijn waarborgt eerlijke en open toegang tot betalingsmarkten en verbetert en standaardiseert de consumentenbescherming. De voordelen van vereenvoudiging vloeien voort uit harmonisatie van de eisen voor toegang tot markten, het wegwerken van de versnippering als gevolg van uiteenlopende nationale en EU-regels betreffende informatie-eisen en uit harmonisatie van de essentiële rechten en verplichtingen van gebruikers en aanbieders, in het belang van zekerheid en efficiëntie. Een efficiëntere en meer concurrerende markt voor betalingen betekent ook dat de Europeanen minder zullen betalen voor bankdiensten; de gemiddelde jaarlijkse kosten daarvan lopen binnen de EU uiteen van 34 euro tot niet minder dan 252 euro;

- De intrekking van het merendeel van de bestaande voorschriften betreffende voorverpakkingen heeft geleid tot opheffing van nationale en communautaire regels voor ongeveer 70 consumentenproducten. Ondernemingen hebben nu meer flexibiliteit om aan de behoeften van consumenten te kunnen beantwoorden;

- Wat douanezaken betreft, heeft de wetgever het 'e-Customs'-besluit betreffende invoering van een Europees elektronisch systeem voor de uitwisseling van gegevens tussen overheidsdiensten en bedrijven goedgekeurd. Gestroomlijnde douaneprocedures met gebruikmaking van geautomatiseerde en aan elkaar gekoppelde douanesystemen zullen de internationale handel stimuleren. Wanneer dit geïntegreerde systeem volledig operationeel is, zal het ondernemingen naar verwachting 2,5 miljard euro per jaar besparen, zodat de benodigde investering van 40 tot 50 miljoen euro per jaar door de Commissie en de lidstaten meer dan lonend is. Het gemoderniseerde Douanewetboek, waarin de douanewetgeving van de Gemeenschap zal worden herzien, zal volgens de plannen in 2008 goedgekeurd worden.

2.3. Voorstellen in behandeling bij de wetgever

Momenteel zijn 44 vereenvoudigingsvoorstellen in behandeling bij de wetgever. Daaronder zijn enkele belangrijke voorstellen die eenmaal goedgekeurd zullen helpen bij het vereenvoudigen van de regelgeving. Voorbeelden:

- De baanbrekende herziening van de verzekeringswetgeving van de EU ( Solvency II ) zal de bescherming van polishouders in de gehele EU verbeteren door middel van meer uniforme en risicogevoelige solvabiliteitseisen voor verzekeringsmaatschappijen. Solvency II zal beter risicomanagement, correcte prijzen en strenger toezicht bevorderen, en zal daardoor het vertrouwen van de consument versterken. Het zal ook de concurrentie bevorderen (met name bij massaproducten zoals motorrijtuigen- en inboedelverzekeringen), een neerwaartse druk op de premies uitoefenen, en productvernieuwing en het internationale concurrentievermogen van de Europese verzekeraars bevorderen. Ten slotte zal de regelgeving transparanter en gebruikersvriendelijker worden doordat de lappendeken van regels in 14 verschillende richtlijnen vervangen wordt door één enkele richtlijn;

- De gedragscode voor geautomatiseerde boekingssystemen is ontwikkeld voor een markt waar zich ingrijpende ontwikkelingen hebben voorgedaan door de afstoting van deze activiteit door de luchtvaartmaatschappijen en de toename van het aantal boekingen via internet, en die nu rijp is voor meer concurrentie. De Commissie stelt voor om de marktwerking meer ruimte te geven om de overdreven hoge kosten van boekingen voor luchtvaartmaatschappijen en passagiers aan te pakken. Door meer concurrentie zal de kwaliteit van de geboden diensten verbeteren en zullen de distributiekosten in de sector luchtvervoer dalen: de boekingskosten per reisonderdeel zullen naar verwachting met ongeveer 0,70 tot 0,90 euro dalen, en de totale kosten met 190-240 miljoen euro per jaar;

- De wijzigingen van de regels betreffende elektronische communicatienetwerken en -diensten zijn gericht op het waarborgen van effectieve concurrentie, het bevorderen van investeringen, het consolideren van de interne markt, en betere bescherming van de belangen van de consument. Daar waar een duidelijke trend naar meer concurrentie bestaat, wordt een aanzienlijke afslanking van de regelgeving aanbevolen. In een onafhankelijk kosten-batenonderzoek betreffende de voorgestelde eCommunications Market Authority worden de potentiële economische voordelen op 10-30 maal de exploitatiekosten (d.w.z. 250-800 miljoen euro) geschat, als gevolg van minder onzekerheid over de regelgeving en snellere oplossing van problemen. De herziening biedt de op het spectrum aangewezen dienstverleners meer flexibiliteit, verlaagt de kosten, en verwijdert obstakels voor nieuwkomers op de markt. Als gevolg daarvan zullen de consumenten kunnen profiteren van meer keuze en lagere prijzen voor deze diensten;

- Een nieuwe richtlijn betreffende het vervoer van gevaarlijke goederen over land zal alle drie vervoersmodaliteiten (weg, spoor en binnenvaart) in één enkel wetgevend instrument behandelen. Het voorstel bevat uniforme bepalingen voor alle drie (voor zover mogelijk) en trekt verouderde bepalingen in. Met name zullen twee richtlijnen betreffende veiligheidsadviseurs voor gevaarlijke goederen en vier besluiten betreffende nationale vrijstellingen ingetrokken worden. Het resultaat zal een gebruikersvriendelijke en transparante tekst zijn die de omvang van het acquis met ongeveer 2 000 bladzijden zal verminderen;

- Door de herziening van de richtlijn betreffende speelgoed zullen de veiligheidseisen worden bijgewerkt en schadelijke effecten op middellange en lange termijn op kinderen worden voorkomen, en zal tegelijkertijd de werking van de interne markt voor speelgoed verbeterd worden. De herziening is in de eerste plaats gericht op het moderniseren van de veiligheidseisen voor speelgoed ten aanzien van de chemische, fysieke en mechanische eigenschappen daarvan. Daarbij zal rekening worden gehouden met de meest recente wetenschappelijke kennis, zodat in de EU alleen veilig speelgoed op de markt gebracht kan worden. Verder zal de controle op de naleving van de richtlijn in de lidstaten verbeterd worden en zullen de verplichtingen van de lidstaten inzake passend en effectief markttoezicht aangescherpt worden.

2.4. Initiatieven in de pijplijn van de Commissie (2008-2009)

De Commissie zal haar inspanningen in de loop van de komende twee jaren verder opvoeren. Het bijgewerkte programma voor 2008-2009 (bijlage 1) bestaat uit 45 initiatieven voor 2008 en 9 initiatieven voor 2009. Voorbeelden van komende vereenvoudigingsinitiatieven zijn :

- Door de herziening van het acquis inzake vennootschapsrecht, accounting en auditing zal een reeks administratieve eisen die intussen als achterhaald, overdreven of overlappend beschouwd worden, geschrapt of verminderd worden. Bepaalde informatie-eisen van de vennootschapsrichtlijnen zullen geschrapt worden, waardoor de openbaarmakingsverplichtingen voor ondernemingen vereenvoudigd zullen worden en de lidstaten de voorschriften voor rapportage en auditing voor KMO's verder zullen kunnen inperken;

- Door de herziening van de algemene groepsvrijstellingsverordening (General Block Exemption Regulation, GBER) zullen alle bepalingen betreffende overheidssteun waarvoor geen verplichting tot kennisgeving geldt, in één document bijeengebracht worden, waardoor de administratieve last voor de begunstigden, de lidstaten en de Commissie zal afnemen. De nieuwe GBER zal terreinen bestrijken waarvoor al groepsvrijstellingen gelden met betrekking tot opleiding, aanwerving en KMO's, en daarnaast ook nieuwe terreinen als milieu, risicokapitaal en regionale steun. De verordening zal ook KMO's veel gemakkelijker toegang bieden tot overheidssteunprogramma's; zo zal bijvoorbeeld de 'KMO-bonus' boven op de gebruikelijke basissteun voor investeringen en werkgelegenheid worden geharmoniseerd en verhoogd van 15% tot 20% voor kleine ondernemingen en van 7,5% tot 10% voor middelgrote;

- De herziening van Intrastat zal de last die het systeem voor de verzameling van gegevens voor de statistieken van de Gemeenschap met betrekking tot de handel in goederen tussen lidstaten voor het bedrijfsleven betekent, beperken. De Commissie zal op korte termijn voorstellen om de regeling verder te vereenvoudigen langs traditionele wegen, door het aantal rubrieken in de nomenclatuur te verminderen en door hogere drempels vast te stellen waardoor een groot aantal ondernemingen van deze verplichtingen vrijgesteld zal worden. Naar schatting zouden tot 190 000 ondernemingen vrijgesteld kunnen worden van de verplichting om deze statistische gegevens te verstrekken. Tegelijkertijd zal de Commissie andere opties voor de lange termijn onderzoeken, waaronder een eventuele overstap naar een 'single flow'-rapportagesysteem;

- De toekomstige verordening betreffende geavanceerde veiligheidskenmerken en banden zal een vijftigtal verschillende richtlijnen vervangen. Dit zal voor de lidstaten een aanzienlijke verlichting van de last betekenen, aangezien zij niet langer EG-regels op dit terrein zullen hoeven omzetten. Bovendien zullen rechtstreekse verwijzingen naar UNECE-verordeningen de onderlinge aanpassing van de EU-wetgeving en de UNECE-regels aanzienlijk versnellen, waardoor de industrie zich sneller zal kunnen aanpassen aan technische ontwikkelingen op internationaal niveau;

- Door de herziening van de richtlijn betreffende afgedankte elektrische en elektronische apparatuur (Waste Electric en Electronic Equipments, WEEE) en de richtlijn betreffende beperking van het gebruik van bepaalde gevaarlijke stoffen in elektrische en elektronische apparatuur (RoHS) zullen bepaalde concepten verduidelijkt en de tenuitvoerlegging en naleving van de richtlijnen vergemakkelijkt worden, terwijl ook de administratieve kosten voor fabrikanten en administraties verminderd zullen worden en de marktdeelnemers meer transparantie en gelijke voorwaarden geboden zullen worden;

- Het voorstel voor een kaderrichtlijn betreffende consumentenrechten zal gemeenschappelijke definities bevatten en de voornaamste contractuele rechten en beroepsmogelijkheden van consumenten regelen. Door het regelgevend kader eenvoudiger en duidelijker te maken, zal deze richtlijn bijdragen tot het goede functioneren van de interne markt en tot meer vertrouwen van de consumenten;

- De modernisering en herschikking van het controlesysteem van het Gemeenschappelijk Visserijbeleid zal de beperkingen voor deze sector verlichten en het gebruik van IT-instrumenten voor de nakoming van rapportageverplichtingen bevorderen.

Vereenvoudigingsinitiatieven die bijzonder relevant zijn voor KMO's zullen ook speciale aandacht krijgen in de “ Small Business Act voor Europe ”, die in 2008 gelanceerd zal worden.

2.5. Vereenvoudiging buiten het lopende programma

De vereenvoudiging blijft niet beperkt tot gerichte programma's zoals het lopende vereenvoudigingsprogramma, het programma ter verlichting van administratieve lasten en het codificatieprogramma. De eis van eenvoud is zonder uitzondering van toepassing op alle wetgevingsvoorstellen, en ook op operationele procedures. Voorbeelden:

- Op het terrein van onderzoek – een centraal element van de Lissabonstrategie – zijn concrete maatregelen voorgesteld ter vereenvoudiging van het 7e kaderprogramma voor activiteiten op het gebied van onderzoek, technologische ontwikkeling en demonstratie . De administratieve en financiële regels zijn dienovereenkomstig aangepast en het management van het kaderprogramma en van individuele onderzoeksprojecten is gestroomlijnd;

- De Commissie heeft voorgesteld de structuur van het Erasmus Mundus- programma te vereenvoudigen in de loop van de tweede fase daarvan (2009-13). Het optreden van de Gemeenschap op het terrein van hoger onderwijs met betrekking tot derde landen zal coherenter worden door de stroomlijning van een groot aantal bestaande programma's, die momenteel onder verschillende regels beheerd worden hoewel zij in essentie dezelfde terreinen bestrijken. Daardoor zal één enkel toegangspunt worden gecreëerd voor alle partijen die betrokken zijn bij academische samenwerking en internationale mobiliteit;

- De Commissie heeft vier aparte bekendmakingen over verschillende jurisdictionele kwesties vervangen en bijgewerkt in één geconsolideerde bekendmaking over de rechtspraak onder de concentratieverordening van de EG. Dit heeft geleid tot een onmiddellijke vereenvoudiging van administratieve praktijken en richtsnoeren;

- De invoering van een 'elektronisch logboek' in de visserij heeft geleid tot een volledig papierloos rapportageproces van visserijgegevens voor vissers en nationale administraties;

- De nieuwe verordeningen voor het cohesiebeleid in 2007-2013 hebben het aantal fondsen en programmeringsstappen gereduceerd en het financieel beheer vereenvoudigd, en daardoor de plaatselijke autoriteiten die de programma's in het veld beheren meer flexibiliteit geboden. De regels betreffende het cohesiefonds en de structuurfondsen zijn geharmoniseerd zodat plaatselijke autoriteiten en begunstigden slechts één set van regels hoeven toe te passen voor beide fondsen. In dezelfde geest heeft één nieuwe verordening van de Commissie betreffende de tenuitvoerlegging van de structuurfondsen 10 toepassingsverordeningen vervangen.

Verder blijft de voltooiing van de interne markt een van de meest effectieve middelen om het ondernemingsklimaat te verbeteren. Het verwijderen van barrières tussen lidstaten heeft het BBP van de EU met 223 miljard euro, ofwel 2,2%, verhoogd in de tien jaren sinds de afronding van het internemarktpakket in 1993. Dat komt neer op 1 450 euro extra inkomen per huishouden. Verder is de werkgelegenheid met 1,4% toegenomen, wat 2,75 miljoen nieuwe banen betekent. Eén pakket van EU-regels betekent dat ondernemingen niet gedwongen zijn 27 verschillende pakketten nationale regels op te zoeken en te ontcijferen, hun producten of diensten daaraan aan te passen, en dan nog aan te tonen dat die regels zijn nageleefd. Enkele voorbeelden:

- De Commissie heeft onlangs voorgesteld de EU- typegoedkeuringen voor voertuigen te wijzigen door geharmoniseerde regels voor motorvoertuigen op waterstof in te voeren, zodat fabrikanten schaalvoordelen kunnen behalen door grotere productieseries voor de hele Europese markt, en de EU-consumenten erop kunnen vertrouwen dat deze innovatieve motorvoertuigen voldoen aan hoge normen inzake veiligheid en milieubescherming. Het aanpassen van het typegoedkeuringssysteem aan de technologieën van morgen zal ook de auto-industrie van de EU in staat stellen om gelijke tred te houden met haar voornaamste concurrenten op wereldschaal en haar concurrentiepositie op de markten van derde landen te verbeteren.

- In december 2007 heeft de Commissie een nieuwe richtlijn voorgesteld die gericht is op het wegnemen van obstakels voor de handel in defensiegerelateerde producten binnen de Gemeenschap . Tot nu toe wordt het verkeer van dergelijke producten op de interne markt belemmerd door een lappendeken van nationale procedures die niet alleen ondernemingen en overheden een administratieve last opleggen die meer dan 430 miljoen euro per jaar vertegenwoordigt, maar ook aanzienlijke vertragingen veroorzaken, vaak van meerdere maanden. Deze last staat duidelijk niet in redelijke verhouding tot de werkelijke noodzaak van controles, zoals blijkt uit het feit dat, hoewel jaarlijks ongeveer 11 500 vergunningen worden aangevraagd voor transfers binnen de Gemeenschap, slechts 3 aanvragen geweigerd zijn in de periode 2004-2006. Dit voorstel zal helpen de Europese defensie-industrie in economisch en technologisch opzicht concurrerender te maken, de voorwaarden voor de actieve betrokkenheid van KMO's bij de ontwikkeling en productie van defensieproducten te verbeteren, de lidstaten in staat te stellen om aan hun militaire behoeften te voldoen bij een redelijk niveau van veiligheid en lagere kosten, en de leveringszekerheid voor overheidsopdrachten en industriële samenwerking te verhogen.

2.6. Communicatie-instrumenten en raadpleging van stakeholders

Duidelijke en transparante informatie over de vooruitgang bij de tenuitvoerlegging van het vereenvoudigingsprogramma is cruciaal voor de instandhouding van het momentum van het programma. De Commissie heeft met het oog daarop een vereenvoudigingswebsite opgezet om algemene informatie over de vereenvoudigingsstrategie te verstrekken en stakeholders in staat te stellen om na te gaan hoe het lopende programma vordert. Verder vergemakkelijken in een aantal sectoren (bv. de landbouw) sectorale groepen de raadpleging van de sectorale deskundigen van de lidstaten en de stakeholders.

In het najaar van 2007 heeft de Commissie, overeenkomstig haar voornemen om vereenvoudiging tot een vast bestanddeel van de praktische ervaring van stakeholders te maken, een nieuwe website voor online-raadpleging gelanceerd waar bedrijven hun klachten en suggesties met betrekking tot de lasten die wetgeving en bureaucratische regelingen in het algemeen veroorzaken, rechtstreeks aan de Commissie kunnen voorleggen. De Commissie zal zoveel mogelijk gebruik maken van deze input van stakeholders. Deze input zal voornamelijk verwerkt worden in het ' Actieprogramma voor het verlichten van administratieve lasten in de Europese Unie' , maar reacties betreffende bredere kwesties in verband met de inhoud van regelgeving zullen worden meegenomen bij de vormgeving van de vereenvoudigingsstrategie.

3. CODIFICATIEPROGRAMMA

Codificatie vormt een essentieel onderdeel van het streven van de Commissie de omvang van het acquis terug te brengen en het toegankelijker te maken.

Het codificatieprogramma omvat ongeveer 400 codificatiebesluiten, in meerderheid wetgevende voorstellen. In totaal hebben momenteel 87 wetsteksten het codificatieproces met succes doorlopen; deze zijn goedgekeurd en gepubliceerd in het PB (62 wetsteksten van de Commissie en 25 wetsteksten van het Europees Parlement en de Raad). Deze 87 wetsbesluiten vervangen 348 eerdere teksten. Verder zijn nog 65 wetsbesluiten in behandeling bij de wetgever en staan er 4 op het punt goedgekeurd te worden door de Commissie. De Commissie heeft dus in totaal al 152 codificatiebesluiten volledig afgehandeld.

Om het codificatieprogramma tegen het einde van 2008 te kunnen voltooien (zie bijlage 2), zijn maatregelen genomen om de achterstand bij de vertalingen van teksten die in de nieuwe EU-talen worden gecodificeerd, weg te werken. De goedkeuring van gecodificeerde wetteksten door de wetgever is onderworpen aan de voorschriften van het Interinstitutioneel Akkoord van 20 december 1994 voor een versnelde werkmethode voor de officiële codificatie van wetsteksten.

4. INTERINSTITUTIONELE ASPECTEN

4.1. Voorstellen die nog bij de wetgever in behandeling zijn

Alle bij het beleidvormingsproces betrokken partijen delen in de verantwoordelijkheid voor succesvolle vereenvoudiging. In 2007 is de wetgever erin geslaagd de achterstand van voorstellen die nog van het vereenvoudigingsprogramma voor 2003-2004 dateerden, weg te werken.

44 voorstellen van het lopende programma voor 2005-2009 zijn echter nog in behandeling bij de wetgever (zie bijlage 3). Voor zover het richtlijnen betreft, moet de EG-regelgeving ook nog in nationaal recht worden omgezet. Er kunnen dus jaren voorbijgaan voordat de burgers en het bedrijfsleven van de voordelen van vereenvoudiging kunnen profiteren (en deze opmerken).

De Commissie heeft er bij de andere instellingen dan ook op aangedrongen haar vereenvoudigingsvoorstellen zo snel mogelijk goed te keuren.

4.2. Vereenvoudiging en de andere instellingen

In het kader van de Lissabonstrategie voor groei en werkgelegenheid beoordeelt de Raad (concurrentievermogen) de tenuitvoerlegging van de 'betere regelgeving'-agenda in een voortgangsverslag aan het einde van elk voorzitterschap, waarin onder andere wordt aangegeven hoe het lopende vereenvoudigingsprogramma vordert. De Commissie verheugt zich over de niet aflatende belangstelling van de Raad voor betere regelgeving in het algemeen en voor vereenvoudiging in het bijzonder, maar moet helaas vaststellen dat de werkmethoden van de Raad inzake het bestuderen van vereenvoudigingsvoorstellen nog niet fundamenteel veranderd zijn, ondanks de toezeggingen die zijn gedaan in het interinstitutioneel akkoord betreffende betere wetgeving.

In zijn resolutie betreffende de strategie voor de vereenvoudiging van de regelgeving, heeft het Europees Parlement het codificatieprogramma van de Commissie positief beoordeeld en ingestemd in met het idee dat het vereenvoudigingsprogramma bevorderd en ondersteund dient te worden door overeenkomstige nationale vereenvoudigingsinitiatieven. Het Parlement nodigt ook de drie instellingen uit om een interinstitutioneel akkoord te sluiten betreffende snellere werkmethoden voor vereenvoudigingsmaatregelen. De Commissie waardeert de constructieve ondersteuning van het Parlement en de reeds ondernomen stappen voor de uitvoering van de 'betere regelgeving'-agenda. De Commissie verheugt zich met name over de aanpassing van de interne procedures van het Parlement voor het bestuderen van voorstellen inzake codificatie en herschikking, waardoor de verdeling van de verantwoordelijkheden over de verschillende comités verduidelijkt wordt en gecodificeerde teksten beschermd worden tegen onnodige of overdreven wijzigingen van de inhoud.

De Commissie dringt bij de de Raad en het Parlement dan ook aan op snelle goedkeuring van de hangende vereenvoudigingsvoorstellen, en voor handhaving van de inhoud in dat proces.

4.3. Samenwerking met het Europees Economisch en Sociaal Comité en het Comité van de Regio's

De Commissie heeft geprobeerd de raadpleging van de maatschappelijke organisaties inzake de regelgevende kwaliteit van het acquis beter te organiseren.

Naar aanleiding van een verzoek van de Commissie heeft het EESC in september 2007 een advies geformuleerd betreffende de mogelijkheden voor vereenvoudiging van het regelgevend kader in de sector machines. Deze vereenvoudiging zou zowel sectorspecifieke regels als bredere wetgeving betreffende machines moeten betreffen, bijvoorbeeld inzake gezondheid, veiligheid en milieubescherming. De Commissie is voornemens deze samenwerking voort te zetten en heeft het Comité verzocht om verdere adviezen betreffende andere belangrijke sectoren, zoals de bouw en zakelijke dienstverlening.

De Commissie begroet eveneens het advies over betere regelgeving dat het Comité van de Regio's in oktober 2007 heeft goedgekeurd.

5. CONCLUSIES / AFSLUITENDE OPMERKINGEN

Het verminderen van administratieve rompslomp is nu een vast punt op de politieke agenda van de Gemeenschap geworden. De vereenvoudigingsstrategie heeft nu, net als de andere onderdelen van de Agenda voor betere regelgeving die de Commissie aan het begin van haar mandaat heeft opgesteld, de kruissnelheid bereikt, en heeft de eerste aanwijsbare en indrukwekkende voordelen opgeleverd. De Commissie zal de screening van de ongeveer 95 000 bladzijden van het acquis van de Gemeenschap voortzetten om terreinen de identificeren waar toekomstige vereenvoudigingsactiviteiten zich op zouden kunnen richten, en zal de resultaten daarvan verwerken in het bijgewerkte lopende vereenvoudigingsprogramma dat begin 2009 gepresenteerd zal worden. De Commissie is vastbesloten het huidige lopende programma tot een succesvol einde te brengen en het acquis zo eenvoudig, slank en actueel mogelijk te maken. De methode blijkt in de praktijk te werken en de actie levert resultaten op.

Het is echter duidelijk dat het regelgevend kader niet door de Commissie alleen verbeterd kan worden. Meer dan ooit is een werkelijke, gecoördineerde en vastbesloten inzet op alle regelgevende niveaus noodzakelijk om politieke goede bedoelingen om te zetten in concrete resultaten en ervoor te zorgen dat aan de legitieme verwachtingen van ondernemingen en burgers wordt voldaan. Het Europees Parlement en de Raad delen de institutionele verantwoordelijkheid voor het voortstuwen van de voorstellen van de Commissie tot aan de uiteindelijke goedkeuring. Ondanks de verrichte inspanningen is tot nu toe minder dan een kwart van alle door de Commissie ingediende vereenvoudigingsvoorstellen waarvoor goedkeuring van de wetgever vereist is, goedgekeurd. Het is natuurlijk essentieel dat de vereenvoudigende elementen van deze voorstellen behouden blijven in de loop van het proces.

In dezelfde geest dienen nationale, regionale en lokale autoriteiten die belast zijn met de omzetting en tenuitvoerlegging van EU-wetgeving voort te bouwen op het in Brussel verrichte werk met betrekking tot vereenvoudiging. Het komt te vaak voor dat late omzetting of lagen toegevoegde overbodige voorschriften ("gold-plating") het vereenvoudigingseffect van EU-regelgeving uithollen. De lopende werkzaamheden met betrekking tot het in kaart brengen en meten van administratieve lasten op bepaalde beleidsterreinen zullen naar verwachting interessante inzichten opleveren wat dit aspect betreft. Overeenkomstig haar recente mededeling "Een Europa van resultaten – toepassing van het Gemeenschapsrecht" zal de Commissie haar inspanningen aan de bron om inbreuken op EG-wetgeving te voorkomen verder opvoeren, door de lidstaten kwalitatief betere ondersteuning te bieden met het oog op de correcte omzetting en toepassing van richtlijnen.

Aangezien de uiteindelijke vormgeving van het merendeel van de EU-regelgeving niet op het niveau van de Gemeenschap plaatsvindt, dienen ook op nationaal – en waar nodig ook op regionaal – niveau vereenvoudigingsprogramma's ontwikkeld of verder uitgebouwd te worden teneinde de administratieve rompslomp aan te pakken die onafhankelijk van de EU-wetgeving voortwoekert. In de toekomst zal de Commissie bijzondere aandacht besteden aan dit aspect bij de beoordeling van de in de context van de Lissabonagenda ingediende nationale hervormingsprogramma's.

For this purpose, the procedure of developing and adopting eco-label criteria will be thoroughly changed and simplified. This partial ban was extended to a total EU wide suspension on the use of processed animal protein in feed for any animals farmed for the production of food on 1 January 2001 with some exceptions like the use of fish meal for non-ruminants. Any presence of prohibited constituents of animal origin in feed is considered as a breach of the feed ban i.e. the zero-tolerance. Following the adoption of the TSE Road map the Commission issued a Commission staff working paper i.e. Work Programme on TSE [SEC(2006) 1527] on future legislative actions in the field of transmissible spongiform encephalopathy. One of the topics concerns a revision of the feed ban provisions. The starting point when revising the current feed ban provisions should be risk-based but at the same time taking into account the control tools in place to evaluate and ensure the proper implementation of this feed ban. | X |

Furthermore, the Directive requires regular inspections of boilers and air-conditioning systems in order to guarantee their energy efficient operation. An amended Directive could enlarge the scope to more buildings, strengthen and specify some of these requirements and add, for instance, financing aspects. The changes under consideration aim at overcoming multiple barriers that hinder the utilization of the vast potential for energy demand reductions in the buildings sector. The recasting of the Directive is part of package on the Strategic Energy Review and included in the Energy Efficiency Action Plan. The amendments will cover some articles of the Directive and add new ones. The 'simplification' will consist of using the 'recasting' technique to facilitate reading and comprehension for the implementing authorities and for the many stakeholders affected. | X |

Revision of the Council Directive 94/56/EC establishing the fundamental principles governing the investigation of civil aviation accidents and incidents and of Directive 2003/42/EC on occurrence reporting in civil aviation | Revision or Recast | The older directive needs to be modernised following the establishment of EASA and following the advice of the Group of Experts established by EC Decision 2003/425/EC. In addition the newer directive needs to be built on to create a minimum set of centralised functions, including a database to allow appropriate entities to carry out trend analysis or other studies, and keep track of safety recommendations, while providing information to the general public. Both directives will be replaced by a single piece of legislation. The objective of the simplification is to take advantage of the necessary revision of the Directive 94/56 to adapt it to recent developments by merging it with Directive 2003/42/EC to create a single legislative act as both directives deal with the use of feedback information to improve accident prevention. |

Modernise the Marine Equipment Directive 96/98/EC | Recast or Revision | The objective is to modernise and reform the existing system established by Council Directive 96/98/EC on marine equipment. Its main objectives are: 1) to produce a consolidated version of the text following the successive amendments of the Directive 2) to improve the functioning of the Directive's system by addressing the existing shortcomings ; 3) to adapt it to the reform of the New Approach. It is intended to abrogate the existing Directive and replace it with an entirely new one, while recourse to recast is not excluded. At present, the Directive needs periodic amendments in order to keep pace with the safety requirements and technical standards produced by the International Maritime Organisation as well as the international and European standardisation bodies. This produces an inevitable mismatch between the European and international regulatory frameworks, sometimes spanning several years, whose correction will greatly facilitate the work of the sectors concerned and thus favour the competitiveness of the European marine equipment industry. Furthermore, the adaptation of the directive to the new regulatory framework for the free movement of goods (revision of the new approach) is expected to improve the readability of this instrument and reduce the administrative burden on the industry. Timing of adoption is conditional on significant progress being achieved by December 2007 in the legislative process as regards the revision of the New Approach. |
