Herziening Europese aanbestedingsrichtlijn

The European Commission announced a review of the Public Procurement Directives (2014/25/EU, 2014/24/EU and 2014/23/EU) (‘the directives’) in April 2019. However, that review was postponed because, according to the Commission, not all member states had sufficiently implemented the directives by that time. While the directives provide an adequate legal framework for public procurement across the Single Market, their implementation and the application procedures leave room for improvement. Given the need for improvements as well as guidance on implementation, can the Commission answer the following questions:

  • 1. 
    Does the Commission consider the transposition of the directives sufficient in all member states?
  • 2. 
    When does the Commission, according to article 92, plan to review the directives and adopt the first implementation report?
  • 3. 
    Many Dutch businesses encounter difficulties with the complexities of tender proposals and procedures, as also illustrated by the relatively high percentage of public tenders only receiving a single bid[1]. How does the Commission aim to ensure that it remains economically viable for businesses to apply for a tender?
