Lecture

In the context of her report on the ongoing dismantling of the Hungarian democracy, Dutch MEP Judith Sargentini will discuss the European Parliament’s resolution against Hungary and the rule of law challenge the EU is facing in the wake of counter-democratic developments in Hungary and Poland.

Summary

On 12 September 2018, the European Parliament adopted a resolution based on a report by Dutch MEP Judith Sargentini, which recommended triggering Article 7 TEU against Hungary. The resolution also called on the Council to determine the existence of a clear risk of a serious breach by Hungary of the values on which the European Union is founded.

Opening the first stage of an EU rule-of-law sanctions mechanism sent a clear warning to the Hungarian government and prime minister Viktor Orbán. Driving Hungary towards what Orbán in 2014 declared an "illiberal democracy" is unacceptable to the EU and its Member States.

Both the vote in the EP and the report itself have drawn wide attention to the systematic and largescale destruction of fundamental rights, independent institutions and other constitutional safeguards of democracy in Hungary since 2010. Orbán and his government have received open and harsh criticism after the vote. However, the destruction of Hungary’s constitutional democracy has continued since September 2018.

Hungary’s case constitutes a major challenge to the European Union’s evolution towards a constitutional and political entity and- together with the developments in Poland since 2015 - has confronted the EU with its first rule of law crisis.

In her lecture at the University of Amsterdam, Judith Sargentini will discuss these developments and the question of “What legal and political actions can the EU and its Member States take?”.

The lecture will be introduced by Kati Cseres, associate professor of law at the Amsterdam Center for European Law and Governance.

Judith Sargentini is a Dutch politician and Member of the European Parliament. She is a member of the Dutch GroenLinks party.
