DECISION No. /…. OF THE JOINT COMMITTEE ON GOVERNMENT PROCUREMENT ESTABLISHED UNDER THE AGREEMENT BETWEEN THE EUROPEAN COMMUNITY AND THE SWISS CONFEDERATION ON CERTAIN ASPECTS OF GOVERNMENT PROCUREMENT
THE JOINT COMMITTEE,
Having regard to the Agreement between the European Community and the Swiss Confederation on certain aspects of government procurement (hereinafter “the Agreement”), and in particular Article 11(4) thereof,
Whereas on 1 May 2004, the Czech Republic, the Republic of Estonia, the Republic of Cyprus, the Republic of Latvia, the Republic of Lithuania, the Republic of Hungary, the Republic of Malta, the Republic of Poland, the Republic of Slovenia and the Slovak Republic became Member States of the European Union,
Whereas on 1 January 2007, the Republic of Bulgaria and Romania became Member States of the European Union,
Whereas on 9 December 2008, the Commission has adopted a Decision of amending the Annexes to Directives 2004/17/EC and 2004/18/EC as regards their lists of contracting entities and contracting authorities,
Whereas it is necessary to amend the annexes of the Agreement to reflect the enlargements of European Union and the resulting increase in reciprocal procurement opportunities under the Agreement,
Whereas it is necessary to adapt the annexes of the Agreement to reflect the update of the lists of the covered entities,
Whereas it is necessary to adapt Annex I of the Agreement to take account of the introduction of effective competition in the telecommunication sector in the European Union and the Swiss Confederation,
HAS ADOPTED THE FOLLOWING DECISION:
Article 1
Amendments to Annex I
Annex I shall be replaced by the following:
“Annex I (referred to in Articles (3) (1) and (2)(a) to (c) and (5) of the Agreement) Telecommunications Operators Covered
Telecommunications operators are no longer covered by the Agreement.”
Article 2
Amendments to Annex II
Annex II shall be amended by the following:
