Considerations on COM(2010)223 - Union position regarding the amendment of the annexes of the Agreement with Switzerland on certain aspects of government procurement

7. The Agreement between the European Community and the Swiss Confederation on certain aspects of government procurement[4] contains annexes that specify which entities of each Member State are covered by the agreement.

8. On 1 May 2004, the Czech Republic, the Republic of Estonia, the Republic of Cyprus, the Republic of Latvia, the Republic of Lithuania, the Republic of Hungary, the Republic of Malta, the Republic of Poland, the Republic of Slovenia and the Slovak Republic became Member States of the European Union.

9. On 1 January 2007, the Republic of Bulgaria and Romania became Member States of the European Union.

10. On 9 December 2008, the Commission has adopted a Decision of amending the Annexes to Directives 2004/17/EC and 2004/18/EC as regards their lists of contracting entities and contracting authorities[5].

11. It is therefore necessary to adapt the annexes of the Agreement between the European Community and the Swiss Confederation on certain aspects of government procurement by adding the lists of covered entities of the new Member States and updating the lists of covered entities of the old Member States.

12. Furthermore, in view of the introduction of competition in the markets for telecommunications services in the European Union and the Swiss Confederation, it is desirable to specify in Annex I of the Agreement that telecommunications operators of the European Union and the Swiss Confederation are no longer covered.
