Article 1

The Economic Partnership Agreement between the Republic of Kenya, Member of the East African Community, of the one part, and the European Union and its Member States, of the other part ('the Agreement'), is hereby concluded.

The text of the Agreement is attached to this Decision.

Article 2

The Council Secretariat General shall designate the person empowered to proceed, on behalf of the Union, to the notification provided for in Article 139 of the Agreement, in order to express the consent of the European Union to be bound by the Agreement 12 .

Article 3

The Agreement shall not be construed as conferring rights or imposing obligations which can be directly invoked before Union or Member State courts or tribunals.

Article 4

This Decision shall enter into force on the date of its adoption.
